Terms of Service

The short version
- Use Restowise to run your restaurant. Don't break the law with it, and don't attack it.
- Your data stays yours. You can export it whenever you like, and we will hand it over if you leave.
- You are responsible for what you put in — especially your staff's personal and pay information, and for telling them you use this.
- Restowise is a record-keeping tool, not a lawyer or an accountant. It does not guarantee your schedules or payroll comply with labour law. Check them.
- The service is provided as-is, and what we owe you if something goes wrong is capped.
- Either of us can end this at any time.
1. The agreement
These terms are between Restowise ("we", "us") and the person or business using it ("you"). By creating an account or using any Restowise app, you accept them. If you are agreeing on behalf of a business, you confirm you may bind it.
Our Privacy Policy is part of this agreement.
2. Accounts
- You must give an accurate email address and keep it working — it is how we reach you and how account recovery happens.
- You are responsible for what happens under your account. Keep your password to yourself, and turn on two-step sign-in if your store handles sensitive data.
- Store owners and administrators can create accounts for staff, set what they can see, and remove them. If you are an owner, that access is a responsibility as well as a convenience.
- Tell us promptly if you think an account has been compromised.
3. Your data
You own everything you put into Restowise. We claim no rights over your staff lists, schedules, payroll, imports, documents or photographs beyond what is needed to run the service for you.
We hold that data on your behalf. You can export it at any time using the export features in the apps, or ask us for a copy. If you stop using Restowise, ask us and we will return or delete it.
What you are responsible for
- Having the right to enter it. Staff pay rates, hours, personal details and uploaded documents are other people's personal information. Only enter what you are entitled to hold.
- Telling your staff. If you record your employees in Restowise, they should know — most places require it, and it is decent practice regardless.
- Accuracy. We do not check whether what you type is correct.
- Who you give access to. Granting someone Manager or Owner hands them real power over your store's data.
4. What Restowise is not
Restowise helps you record and organise. It does not tell you what the law requires, and getting a green tick from it is not a legal defence.
- Not legal or employment advice. Break-compliance warnings, overtime flags and scheduling constraints are conveniences built from rules as we understand them. Labour law varies by state and city and changes. Confirm your obligations yourself.
- Not payroll filing or tax advice. Payroll features produce figures and documents. They do not file anything, calculate your taxes, or make you compliant with wage-and-hour law.
- Not a food-safety authority. HACCP and checklist logs record what your team entered. Whether your operation is safe and compliant is on you and your inspector.
- Generated output is a draft. Schedules, analytics figures and parsed reports are suggestions produced from what you entered. Read them before acting. They can be wrong.
5. Acceptable use
Don't:
- Break the law, or use Restowise to help someone else do so.
- Try to reach another store's data, probe for holes, or get around permission checks.
- Upload malware, or content you have no right to upload.
- Scrape, resell or rebrand the service, or hammer it with automated traffic that degrades it for others.
- Use it to harass or unlawfully surveil your staff.
We may suspend an account that is doing any of this, and we will tell you why where we can.
6. Availability
We aim to keep Restowise running and we do not promise a specific uptime. There will be maintenance, and there will be outages we do not control — our hosting, database or email providers going down takes us with them.
Keep your own copies of anything you cannot afford to lose. Every app can export, and the payroll and reporting apps produce downloadable documents. Use them.
Features change. We may add, alter or withdraw them. If we remove something you depend on, we will give reasonable notice.
7. Fees
Where a plan carries a fee, the price, billing period and what is included will be stated when you subscribe, and that statement governs. Fees are payable in advance and are not refundable except where the law requires or we agree otherwise. We will give at least 30 days' notice before a price change affecting you.
8. Ending it
- You can stop at any time. Owners and administrators can delete accounts from the Admin Panel, or ask us.
- We can suspend or end access for a serious or repeated breach of these terms, for non-payment, or if we are required to.
- Ask for your data within 30 days of closing and we will provide it. After that it may be gone.
- Deleting a person's account does not delete the store's records. Schedules, imports and payroll they entered transfer to the store owner, and the audit log keeps their name against what they did.
9. Our intellectual property
The software, its design, the Restowise name and the mark belong to us. Using the service does not transfer any of that. You may not copy, decompile or resell the software.
If you send us feedback or a suggestion, we may act on it freely and owe you nothing for it.
10. Warranties and liability
Restowise is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that its output will be accurate or legally compliant.
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost revenue, lost goodwill, or lost or corrupted data. Our total liability for any claim is capped at the greater of the fees you paid us in the twelve months before the claim, or US$100.
Some jurisdictions do not allow these exclusions, so parts may not apply to you.
11. Indemnity
You will defend and indemnify us against claims arising from your use of Restowise, your data, or your breach of these terms — including claims by your own staff about how their information was handled, where that handling was your decision rather than ours.
12. Changes
We may update these terms. If a change is material we will update the date above and notify account holders by email. Continuing to use Restowise after a change means you accept it. If you do not, stop using the service and ask for your data.
13. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The state and federal courts located in California have exclusive jurisdiction, and both of us consent to that.
14. Odds and ends
- If a provision is unenforceable, the rest stands.
- Not enforcing something once does not waive it.
- You may not transfer this agreement without our consent. We may transfer it as part of a sale of the business.
- These terms and the Privacy Policy are the whole agreement between us about the service.
